When unemployed, registering for unemployment insurance is an important step so you can receive financial support during difficult times. However, this process requires you to prepare all the necessary documents to ensure your rights are protected.

Unemployment insurance acts as a lifeline for workers during difficult times when losing their jobs.

This regime helps compensate part of income, support vocational training and finding new jobs through the Unemployment Insurance Fund (according to Clause 4, Article 3 of the 2013 Employment Law).

Subjects required to participate in unemployment insurance

Three subjects are required to participate in unemployment insurance

Pursuant to Article 43 of the Employment Law 2013, subjects required to participate in unemployment insurance (UI) include:

First , employees work under a labor contract or employment contract including:

  • Labor contract/working contract without clearly defined term;
  • Labor contract/working contract with a specific term;
  • Seasonal labor contracts or contracts for a certain job have a term of 3 months – less than 12 months.

Second , employees as prescribed in Clause 1, Article 43 of the 2013 Employment Law who are receiving pensions or domestic workers do not have to participate in unemployment insurance.

Third , employers required to participate in unemployment insurance include:

  • State agencies, public service units, people’s armed forces units;
  • Political organizations, social organizations, socio-professional organizations, socio-political organizations, socio-political-professional organizations;
  • Foreign agencies and organizations or international organizations operating in Vietnamese territory;
  • Enterprises, cooperatives, business households, cooperative households, and other organizations. And individuals hire and use workers according to work/labor contracts according to regulations.

What documents are needed to apply for unemployment insurance?

There are two forms of unemployment insurance payment

Currently, there are two forms of submitting unemployment insurance applications: direct submission and online submission. Depending on the form of submission, employees need to prepare different types of documents.

Below are details about unemployment insurance records:

Unemployment insurance applications are submitted directly

Pursuant to Article 16 of Decree 28/2015/ND-CP, amended by Decree No. 61/2020/ND-CP, if employees apply for unemployment insurance directly, they need to prepare the following documents: :

  • 01 application for unemployment benefits according to the prescribed form.
  • 02 copies of confirmation of termination of labor contract/working contract. The certificate can be an original or a certified copy. Or a copy accompanying the original for comparison by state agencies. Confirmation of termination of labor/employment contract can be one of the following documents:
    • The labor/work contract has expired or the work under the contract has been completed;
    • Decided to resign;
    • Resolved excommunication;
    • Disciplinary decisions forcing employees to quit their jobs;
    • Notice/agreement on termination of labor contract/working contract;
    • Employee’s confirmation of termination of labor contract/working contract;
    • Certificate from a competent state agency on the dissolution or bankruptcy of the unit, enterprise or cooperative;
    • Decide to dismiss, dismiss, or dismiss managers of units, enterprises, and cooperatives.
  • Original social insurance book (social insurance) with stamp confirming the insurance payment period.

In addition, when applying for unemployment insurance, employees need to prepare an additional copy of their ID card/Citizen identification card or valid passport.

Similar to unemployment insurance applications submitted online, when submitting online applications, employees also need to prepare a photocopy or scan of one of the documents proving the termination of the labor/working contract. Documents proving the termination of the labor contract/working contract are clearly stated above.

Although submitting an online application does not require submitting a social insurance book (social insurance). However, employees must ensure that their entire unemployment insurance payment process has been confirmed by the social insurance agency on the system.

Where can I file for unemployment insurance?

According to the provisions of Clause 1, Article 46 of the 2013 Employment Law, in order to receive unemployment benefits, within 03 months from the date of termination of the labor/employment contract, the employee must submit an application for unemployment benefits. request benefits for the employment service center.

According to the provisions of Clause 1, Article 17 of Decree No. 28/2015/ND-CP, unemployed workers can apply for unemployment insurance at any local employment service center.
